Terms and Conditions
USAGE RIGHTS AND OWNERSHIP: The Photographer retains the copyright and ownership of all Image (s). Clients are granted a non-exclusive, non-transferable, non-sub-licensable license for personal or commercial use, as specified in the invoice or Agreement.
Image(s) may not be used in logos, trademarks, or other branding materials unless explicitly agreed upon in writing.
Photographer reserves the right to use Image (s) for self-promotion on their website, social media, or marketing materials.
PHOTOGRAPHIC INTEGRITY AND ALTERATIONS: The Client agrees not to alter Image (s) without written permission from the Photographer. This includes but is not limited to filters, cropping, or significant edits.
Portrait sessions include basic editing (color, crop, contrast, and exposure). Product photography includes professional adjustments to ensure accurate representation. Advanced retouching is available at an additional cost.
GENERAL LIABILITY AND RELEASES: The Photographer will take all reasonable care during sessions but is not liable for any loss, damage, or costs resulting from the Image (s). The Client agrees to indemnify and hold harmless the Photographer from any claims related to using the Image (s).
Obtaining necessary model, property, or trademark releases is the Client's responsibility unless otherwise stated in writing.
PAYMENT TERMS: A non-refundable 50% retainer fee is required to secure your booking and is non-refundable. The remaining balance is due on the session date.
No Image(s) will be delivered or licensed until full payment is received.
ACCEPTED FORMS OF PAYMENT FOR PHOTOGRAPHY SHOOT:
Harmony Archer Photography accepts the following forms of payment:
- Check
- Cash
- Major Credit Cards
CANCELLATIONS AND RESCHEDULING: The retainer fee is non-refundable in the event of cancellation. Rescheduling must be agreed upon in writing.
RESHOOTS: No additional fees will apply if a reshoot is required due to factors beyond the Photographer's control (e.g., weather). If the Client requests a reshoot, additional charges may apply.
FAILURE TO PERFORM: If the Photographer cannot perform services due to illness, accident, or unforeseen circumstances, efforts will be made to find a replacement. All fees will be refunded if unsuccessful, and the Photographer will have no further liability.
DIGITAL FILES AND PRINTS: Clients will receive high-resolution digital Image (s) suitable for printing.
The Photographer offers a professional print shop integrated with the online gallery. Clients receive a discount on print orders using a private code.
Photographers are not responsible for print quality from third-party vendors.
ORDER ACCEPTANCE OF PRINTED IMAGES THROUGH THE PRINT SHOP:
All orders are subject to acceptance by Harmony Archer Photography. Upon receiving your order, we will send you an email confirmation summarizing the order details. If we cannot fulfill your order, we will contact you and provide a full refund where applicable.
PRINT SHOP PRICING AND CONDITIONS:
Pricing: Prices for our products are displayed in U.S. dollars and are subject to change without prior notice. Prices do not include applicable taxes or shipping fees, which will be calculated at checkout.
Payment: Full payment is required at the time of order. We accept major credit cards and other payment methods displayed on our website. You confirm you are authorized to use the chosen payment method by submitting your payment information.
ARCHIVING DIGITAL FILES: Photographers may archive Image (s) but do not guarantee availability beyond initial delivery.
Reproduction requests after delivery may incur a $100 processing fee.
SESSION TERMS: Sessions will be conducted at a mutually agreed location. The Client is responsible for obtaining necessary permissions for private property use.
No additional photographers or videographers are allowed during sessions unless agreed in writing.
ACCEPTANCE OF TERMS: Payment of a retainer fee or use of Image (s) constitutes acceptance of these Terms and Conditions. Excepted payment
This Agreement represents the entire understanding between Harmony Archer Photography and the Client. No changes are valid unless agreed upon in writing by both parties.
